Fighting your corner
If you're one of the quarter of all Britains holiday makers that have their holiday ruined by suffering from food poisoning or illness whilst abroad then you could be entitled to claim compensation.
You look forward to it all year, then when you finally get to go on holiday, you are struck down with food poisoning. There is nothing worse than feeling sick whilst on holiday. Not only can it ruin your holiday for you and your family or friends but it could also lead to incurring out of pocket medical expenses, and leave you with health problems which could affect you later in life.
Outbreaks of food poisoning or norovirus in hotels or resorts or on cruise ships can often affect hundreds or thousands of people during their holiday. This is particularly true on board cruise ships or at all inclusive hotels where guests are eating at buffet style restaurants.
Yet many of the people we speak to are unaware that they may be able to make a claim for compensation.
Tour operators have a duty to ensure that the hotels that provide them with services are compliant with international food safety standards and general hygiene procedures.
If your illness was contracted at your holiday hotel, you may be able to bring a claim against your tour operator here in the UK under the Package Travel Regulations 1992.
This means that if your illness was the caused by poor food or hygiene standards at your hotel or resort, your tour operator may be liable.
Of course, not all cases of illness will be as a result of acts or omissions by the hotel. Sometimes sickness may be just due to a change in diet or from sun stroke.
Our dedicated holiday claims team can offer you the advice you need and help you make a successful claim for compensation.
You will usually have three years in which to make a holiday illness claim. However, the earlier you make a claim the greater your chance of success.
Our claims specialists can quickly tell you if you have a valid claim and the amount you are likely to receive back. Simply click the "Can I Claim" button, complete the form and we'll quickly assess your claim.
